6. Subscriptions & Payments
Moodergy offers free and paid subscription plans. For paid subscriptions:
Billing
- Subscriptions are billed in advance on a monthly or yearly basis
- Prices are in US dollars unless otherwise stated
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method automatically
Cancellation
- You may cancel your subscription at any time
- Cancellation takes effect at the end of your current billing period
- You retain access to paid features until the period ends
- No partial refunds for unused time
Price Changes
- We may change prices with 30 days' notice
- Price changes apply at your next renewal
- Continued use after notice constitutes acceptance
7. Prohibited Uses
You agree NOT to use the Service to:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- • Non-infringement of third-party rights
- • Uninterrupted or error-free operation
- • Accuracy or reliability of AI-generated content
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOODERGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification
You agree to defend, indemnify, and hold harmless Moodergy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit through the Service
11. Dispute Resolution
Binding Arbitration (US Users)
For users in the United States, any dispute arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, rather than in court. You waive your right to participate in class action lawsuits.
Exception: Claims for injunctive relief or claims regarding intellectual property may be brought in court.
Informal Resolution First
Before initiating arbitration, we encourage you to contact us at legal@moodergy.com to attempt informal resolution. Most disputes can be resolved quickly this way.
12. US State-Specific Terms
Certain US states have specific consumer protection laws. The following provisions apply where required:
California Residents

New Jersey Residents

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

- We may delete your account and data (subject to our 90-day grace period)
- Provisions that should survive termination will remain in effect
